Overview

DLA Piper and Mason Hayes+Curran have together undertaken a study entitled "Monitoring and analysis of technology transfer and intellectual property regimes and their use", financed by the European Commission. The project ran from 2006 to 2009. All deliverables are now available on this website.

Objective

The main objective of this study was to foster the development and use of European intellectual property systems in a research policy perspective. Two different categories of issues were to be addressed: legal topics on the one hand, and issues relating to training and awareness on the other hand.

Analysis of specific legal issues - A number of research-related topics were investigated, to contribute to improving the regulatory environment for R&D in Europe. For each topic, a clear analysis was made of the situation in the EU and of its impact, both at a national and international level, with a view to developing policy recommendations. Analyses not only focused on patent law, but also extended to other categories of IP rights, such as copyright or database rights.
Analysis of awareness/training issues - Data was also collected, and best practices identified, regarding the introduction of research-related intellectual property issues (including technology transfer basics) in science, engineering and business school curricula.
